Hoje à noite, enquanto a Argentina estreia contra a Argélia na Copa do Mundo de 2026, uma medida adotada pelo país vizinho está chamando atenção muito além das quatro linhas.
Isso porque o governo argentino compartilhou com as autoridades dos Estados Unidos uma base contendo aproximadamente 13 mil pessoas inscritas no registro de devedores de pensão alimentícia.
O compartilhamento dessas informações faz parte do programa Tribuna Segura e alcança os responsáveis que tiveram o inadimplemento da obrigação alimentar formalmente reconhecido pela Justiça argentina e foram incluídos no denominado Registro de Deudores Alimentarios Morosos (RDAM).
Como consequência, os inscritos no RDAM estão impedidos de ingressar nos estádios da competição, incluindo o Arrowhead Stadium (Kansas City Stadium) e os demais palcos da Copa em solo americano.
Não é novidade que, ao longo dos anos, os estádios fecharam suas portas para torcedores violentos e pessoas consideradas ameaça à ordem pública.
Contudo, a Argentina amplia esse conceito e transfere a discussão da segurança pública para outro campo: o da responsabilidade familiar e social.
Por certo, a iniciativa procura combater uma aparente contradição, já que cidadãos alegam incapacidade financeira para cumprir suas obrigações alimentares, mas dispõem de recursos para viajar ao exterior e assistir à Copa do Mundo.
Como alguém não consegue pagar a pensão alimentícia, mas consegue viajar para acompanhar o maior evento do futebol mundial?
Sem adentrar nas potenciais discussões jurídicas quanto a esta restrição, sob a ótica de Compliance o caso é bastante interessante.
Afinal, compliance, em sua essência, está relacionado à conformidade com regras, deveres e expectativas legítimas estabelecidas por uma organização ou pela própria sociedade.
Aqui, o acesso a um dos maiores eventos esportivos do planeta foi condicionado ao cumprimento de uma obrigação legal considerada fundamental: o dever de sustento dos filhos.
Portanto, na prática, estamos diante da utilização de mecanismos de controle de acesso para fins de indução de comportamento, aproximando conceitos de integridade, responsabilidade social e accountability.
Nesse contexto, estar em compliance não se resume a controles, regras ou sanções.
Trata-se de alinhar comportamentos individuais às expectativas legítimas de uma coletividade.
A discussão deixa de ser apenas sobre quem pode entrar em um estádio e passa a refletir sobre quais deveres uma sociedade considera suficientemente relevantes para condicionar o exercício de determinados privilégios.
Até que ponto o acesso a experiências, benefícios e oportunidades pode ser utilizado como instrumento para incentivar comportamentos socialmente responsáveis?
Essa talvez seja a principal reflexão trazida pelo caso argentino.
